Article 2 – Applicability
2.1 These Terms & Conditions apply to every offer, order and distance agreement made with Equithink.
2.2 Placing an order means you agree to these Terms & Conditions.
2.3 Customer terms and conditions do not apply unless accepted explicitly and in writing by Equithink.
Article 3 – Agreement
3.1 After placing an order, you will receive an order confirmation by email. The agreement is established only after the payment is successfully completed.
3.2 Equithink may refuse an order or apply special conditions if necessary. Orders cannot be accepted if the customer’s address cannot be verified.
3.3 If an order is interrupted before the payment is completed, it is not binding, even if you have received an automatic confirmation.
3.4 For direct sales at events or fairs, agreements are concluded verbally and confirmed once payment is completed.
Article 4 – Prices and Costs
4.1 Prices listed in the webshop at the moment of ordering apply.
4.2 The prices displayed in the webshop initially include Dutch VAT, as required by law for the default display. During checkout, the correct VAT rate for the customer’s country (for EU customers) or the VAT-free export price (for customers outside the EU) is automatically applied once the delivery address is entered. Shipping costs are not included in the listed prices and are shown during checkout. Any import duties, handling fees or local taxes charged by the destination country are not included in the order total and must be paid directly by the customer to the carrier or customs authorities.
4.3 Equithink is not bound by obvious printing, programming or typographical errors.
4.5 For customers outside the EU, import duties, handling fees and/or local taxes may be charged by the destination country. These fees are not included in the order total. By placing an order, the customer explicitly agrees to pay all import duties, handling fees and local taxes, to cooperate with the carrier (such as DHL or UPS) to enable delivery, and not to refuse the parcel due to import charges. All costs resulting from refusal, non-payment or lack of response, including return shipping costs, customs storage fees and destruction fees charged by the carrier, are the responsibility of the customer. If the customer fails to pay the required import charges or is unreachable for the carrier, the parcel may be returned or destroyed. In such cases, all costs are the responsibility of the customer. Equithink is not required to refund any shipping costs or resend the products.
Article 5 – Delivery and Execution
5.1 Equithink takes the greatest possible care in the processing and shipping of orders.
5.2 Delivery takes place at the address provided by the customer during checkout, or directly during an event sale.
5.3 The processing time of an order is generally 2–3 working days, unless otherwise indicated. This processing time is indicative and not a guarantee.
5.4 The actual delivery time depends on factors beyond the control of Equithink, including but not limited to the selected carrier, international transport conditions, customs procedures, local postal services and busy periods. Any delays caused by such factors cannot be attributed to Equithink and do not give the customer the right to cancel the agreement or claim compensation.
5.5 International shipments may be subject to additional customs procedures or local regulations, which may cause delays.
5.6 If delivery is delayed or prevented because the customer is not reachable, does not pay import duties, has provided an incorrect address or otherwise hinders delivery, Equithink is not responsible for any resulting delay or costs.
5.7 If a parcel is returned because it could not be delivered, because import charges were not paid or because the customer did not respond to contact attempts from the carrier, both the original shipping costs and all return costs, storage fees or other carrier charges are the responsibility of the customer. Equithink is not obliged to refund shipping costs or resend the order.
Article 6 – Warranty and Liability
6.1 Equithink provides warranty only on manufacturing defects. This warranty does not cover normal wear and tear, damage caused by horses interacting with the puzzles or damage resulting from incorrect installation or use.
6.2 Equithink is not liable for any direct or indirect damage caused by the use of our products, unless caused by intent or deliberate recklessness by Equithink. Using the puzzles is the customer’s own responsibility. Horses are living, unpredictable animals; supervision and proper installation are required at all times.
6.3 Warranty becomes void if the product has been incorrectly installed, improperly used, modified or repaired without written permission from Equithink.
Article 7 – Right of Withdrawal
7.1 The customer may return a product within 14 days of receiving it, without giving any reason. Both the original shipping costs and the return shipping costs are the responsibility of the customer.
7.2 To exercise the right of withdrawal, the customer must notify Equithink by email at mail@equithink.nl within the 14-day period. After receiving the request, Equithink will provide the necessary return instructions.
7.3 During the withdrawal period, the customer must handle the product and its packaging with care. The product may only be used to the extent necessary to establish the nature and functioning of the product, similar to how it may be inspected in a physical shop. If the product has been used beyond this, or is returned incomplete or damaged, Equithink may charge the customer for any loss in value.
7.4 Returned products must be complete, unused (beyond normal inspection), undamaged and, as far as reasonably possible, in the original packaging.
7.5 Any additional costs charged by carriers, customs or other authorities in relation to the return shipment, such as import duties, handling fees or brokerage charges, are also for the customer.
7.6 The customer is responsible for the returned product until it has been delivered to Equithink. Using a trackable shipping method and adequate packaging is strongly recommended. After receiving and inspecting the returned product, Equithink will process the refund of the purchase price as soon as reasonably possible.
Article 8 – Incorrect or Faulty Delivery
8.1 If you receive an incorrect item or believe a product is faulty, you must notify Equithink as soon as possible by emailing mail@equithink.nl. We may request photos or additional information to assess the situation.
8.2 After receiving the customer’s notification, Equithink will assess the issue and provide an appropriate solution. Any reimbursement of costs, replacement of the product or other form of resolution will be determined on a case-by-case basis.
Article 9 – Complaints
9.1 Complaints about orders, payments or deliveries must be submitted by email.
9.2 Complaints must include your name, email address, order number and item number.
9.3 General questions can also be sent to mail@equithink.nl.
Article 10 – Age Restriction
Equithink does not accept orders from persons under 18 years old.
Article 11 – Payment
11.1 The available payment methods depend on the customer’s country and the payment options offered by our webshop at the time of purchase.
11.2 All payments must be completed according to the instructions provided during the checkout process.
11.3 The customer can see all currently available payment methods directly on the checkout page of the webshop.
Article 12 – Privacy
12.1 By placing an order, you give permission for Equithink to process your personal data as required for order fulfilment and customer communication.
12.2 Your data will not be shared with third parties for commercial purposes without your explicit consent.
12.3 You have the right to access and correct your personal data.
12.4 See also our Privacy Policy.
Article 13 – Applicable Law, Jurisdiction & Exclusions
All agreements with Equithink are governed exclusively by Dutch law. Any dispute will be submitted exclusively to the competent court in the Netherlands. No foreign courts or jurisdictions apply. The laws of any other country do not apply, including but not limited to: the United States, Canada, the United Kingdom, Australia or any other non-EU jurisdiction. International customers retain only the mandatory consumer rights that legally cannot be excluded in their own country (if applicable). The Vienna Sales Convention (CISG) does not apply.
